Insurance Disclosure Statement

Welcome to Hoosier Buddy LLC ("we," "us," or "our"). By using our moving services, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before using our services. If you do not agree with any part of these terms, please do not use our services.

Insurance Coverage Information:

Workers Compensation Insurance: Hoosier Buddy LLC does not currently provide workers' compensation insurance, as the owners are the sole employees at this time.

Commercial General Liability Insurance: Our company maintains the following limits of liability under our Commercial General Liability Insurance policy:

  • General Aggregate: $2,000,000

  • Product & Completed Operations Aggregate: Included in the General Aggregate

  • Personal & Advertising Injury: $1,000,000 coverage

  • Damage To Premises Rented To You: $100,000

  • Medical Expense (any one person): $5,000 in coverage

  • Cargo Insurance: Our cargo insurance provides coverage up to $100,000.

  • Intrastate Ops: Claims paid at 30 cents per pound up to $100,000 Limit

  • Interstate Ops: Claims paid at 60 cents per pound up to $100,000 Limit

 

Explanation of Each Coverage:

  • Workers Compensation Insurance: As we do not have employees other than the owners, we do not offer workers' compensation insurance at this time. In the event of injury to any of our employees (owners) or individuals on the property during the moving process, our Commercial General Liability Insurance includes Medical Expense coverage of up to $5,000 for any one person. This coverage ensures that necessary medical expenses are promptly addressed in case of injury, reaffirming our commitment to safety and the well-being of all parties involved.

  • Commercial General Liability Insurance: This coverage protects against claims of bodily injury or property damage that may occur during our moving services. It also provides coverage for personal and advertising injury, damage to premises rented to us, and medical expenses resulting from accidents.

  • Cargo Insurance: Cargo insurance provides coverage for the loss or damage of your belongings while they are in our care during the move.

 

Claims and Appeal Process:

Claims Process:

  • Notification: To report any damaged or lost items, please contact us as soon as possible after the move via email or phone, providing details about the affected items.

  • Documentation: Supporting documentation, including photographs of damaged items, inventory lists, and any relevant information, will aid in processing your claim.

  • Review: We will review your claim and documentation, which may include an inspection of the damaged items if necessary.

  • Resolution: Following the review, we will respond to your claim with either a settlement offer or, in some cases, a denial of the claim.

 

Appeal Process:

  • Request for Appeal: If you are dissatisfied with the initial resolution, you may request an appeal via email or phone.

  • Designated Authority: An impartial authority within our company will handle appeals and is not involved in the initial decision.

  • Appeal Documentation: You may be asked to provide additional documentation or reasons supporting your appeal.

  • Review: The designated authority will thoroughly review your appeal and all relevant information.

  • Response: After the review, we will provide a response to your appeal, which may result in the acceptance of the appeal with a revised resolution or a denial of the appeal with reasons provided.

 

Dispute Resolution:

  • Informal Resolution: We encourage both parties to attempt to resolve disputes through informal discussions and negotiations, as many disputes can be resolved amicably in this manner.

  • Mediation: If informal resolution attempts fail, mediation may be agreed upon, involving a neutral third party to facilitate discussions and find a mutually acceptable resolution. For additional information about our Mediation Process, please refer to our Mediation and Arbitration Policy here.

  • Arbitration: If mediation is unsuccessful, the dispute may proceed to arbitration, where an arbitrator, often chosen by both parties, makes a binding decision to resolve the dispute, which is legally enforceable.   • Legal Action: In the event that all other methods fail, either party may choose to take legal action to resolve the dispute, with the jurisdiction specified in the "Governing Law" section. It is important to note that the party initiating such action, whether it be the customer or Hoosier Buddy LLC, shall bear sole responsibility for all legal fees, court costs, and related expenses incurred during the legal proceedings. This includes, but is not limited to, attorney fees, filing fees, expert witness fees, and any other expenses directly associated with the legal dispute. The jurisdiction for any legal action shall be determined in accordance with the governing law specified in this disclosure.

 

Governing Law:

Any disputes arising from this Agreement shall be subject to the laws of the state in which the Services are provided and shall be construed in accordance with those laws.

 

Reviews and Updates

At Hoosier Buddy LLC, we are committed to providing our customers with transparent and up-to-date information regarding our insurance coverage. To ensure that you are well-informed about our insurance policies and coverage limits, we periodically review and update our Insurance Disclosure Statement.
